Terms of Use for Owners

§ 1 Scope, provider

(1) These Terms apply to the use of the GREM platform via the website grem.immo, the user account in the web browser (hereinafter the “GREM account”) and the GREM apps (together the “Platform”) by owners who wish to sell or let a property in Germany. The provider is GREM CAPITAL LIMITED, 54 Kestrel Avenue, SE24 0EB London, Vereinigtes Königreich (hereinafter “GREM”).

(2) The Terms of Use for Buyers apply to prospective buyers and tenants (hereinafter “prospects”), and the General Terms and Conditions for Makler apply exclusively to Makler and Makler firms.

(3) The General Terms and Conditions for Owners apply additionally to owners, in particular to the paid GREM packages, the report audit and the right of withdrawal. In the event of conflict, the General Terms and Conditions for Owners take precedence for owners.

(4) For owners, these Terms replace the Terms of Use for Owners and Prospects of 4 November 2026. Anyone who has accepted that version uses the Platform on its terms until this version becomes effective for them in accordance with § 8.

§ 2 Role of GREM

(1) GREM shows owners Makler in the vicinity of their property, with profile and ratings. The owner decides for themselves whether to choose a Makler and which one.

(2) GREM is not a Makler. GREM is not a party to any Makler contract, purchase agreement or lease agreement, does not conduct negotiations and does not participate in the conclusion of such contracts. The Makler contract, any exclusivity and the commission are agreed directly between the owner and the Makler.

(3) GREM reviews neither the legal circumstances of a property nor the work of a Makler. The review of ownership and encumbrances is a matter for the notary and the contracting parties.

§ 3 Costs and GREM packages

(1) Registration, creating a property, the AI valuation, choosing a Makler and messages with the Makler are free of charge for owners. GREM charges the owner neither a basic fee nor a commission. The owner agrees the Makler contract, any exclusivity and the commission solely with the Makler.

(2) Insofar as the Platform offers them for ordering, the owner may, if they so wish, order a paid GREM package for a property on a one-off basis:

Paket – €290 incl. VAT: editing and retouching of the photos, virtual staging, floor plan, property description and translations, PDF exposé, Reels 10 sec. (short video in portrait format), landing page for the property and direct contact with prospects via GREM;
Premium – €490 incl. VAT: all services of the Paket plus a 3D tour of up to 40 points, a property video of 32 sec. and a video presentation with an AI avatar;
Upgrade Paket → Premium – €200 incl. VAT: additional charge for owners who have already booked the Paket.

(3) You are paying for the creation and publication of your marketing materials. GREM does not procure buyers and receives no commission. The package price is not consideration for buyers, prospects or contacts. GREM establishes direct contact with prospects only within the scope of a package; without a package, GREM does not connect the owner directly with prospects.

(4) The price is displayed before the order is placed as a final price including VAT. When ordering, the owner confirms the following declaration by ticking a mandatory box: “I expressly request that GREM begin providing the service before the end of the withdrawal period. I am aware that my right of withdrawal expires upon complete provision of the service.” By clicking “Order with obligation to pay” („Zahlungspflichtig bestellen“), the owner submits a binding offer; the contract is concluded upon successful payment. The General Terms and Conditions for Owners and the Withdrawal Instructions apply.

(5) For packages already booked, the scope of services with which they were booked applies.

§ 4 Registration, account

(1) Use requires an account. The user must be of legal age and provide true information. Login credentials must be kept secret.

(2) When creating a property, owners confirm that they are the owner or are entitled to market it. GREM may request evidence of this and may remove a property from the marketplace until the matter has been clarified.

(3) The user may delete their account at any time in the GREM account. GREM may terminate a free account with two weeks’ notice and may block it immediately in the event of misuse. Packages already paid for remain unaffected; in this respect, the General Terms and Conditions for Owners apply.

§ 5 Transmission of contact details

(1) An owner’s contact details are transmitted only to the Makler whom the owner has chosen or to Makler to whom the owner has expressly released their request. The number of recipients is displayed before the release.

(2) A prospect’s contact details are transmitted only to the party offering the requested property or to Makler whom the prospect selects.

(3) In each case, transmission takes place only with consent, which the user may withdraw at any time with effect for the future.

(4) The owner may release a Makler at any time. The owner’s statement as to why they no longer work with the Makler is included, in anonymised form, in the Makler’s rating.

§ 6 Content, AI

(1) Users upload only content to which they hold the rights, and no unlawful content.

(2) AI valuations and market analyses are non-binding, automatically generated estimates and not an expert opinion.

(3) The free tools and the tools of the packages are subject to reasonable use (fair use) for the properties created in the account; in particular, the number of AI valuations per property may be limited. In the event of excessive use, GREM may temporarily restrict use. The services described in the package remain unaffected by this.

(4) How GREM processes personal data is explained in the Privacy Policy.

§ 7 Liability

(1) GREM is liable without limitation in cases of intent and gross negligence, for injury to life, body or health, and under the Product Liability Act.

(2) In cases of slight negligence, GREM is liable only for breach of material contractual obligations and limited to the foreseeable damage typical for the contract.

(3) GREM is not liable for the information and services of Makler and other users.

§ 8 Amendments

Amendments to these Terms will be communicated by e-mail at least four weeks before they take effect. The user may delete their account until then.

§ 9 Final provisions

(1) The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected.

(2) The language of the contract is German. Translations are for information only.

(3) If any provision is invalid, the remainder of the contract remains valid.
