Terms of Use for Buyers

§ 1 Scope, provider

(1) These Terms apply to the use of the GREM platform via the website grem.immo, the user account in the web browser (hereinafter the “GREM account”) and the GREM apps (together the “Platform”) by persons who wish to buy or rent a property in Germany (hereinafter “buyers”; prospective tenants are included). The provider is GREM CAPITAL LIMITED, 54 Kestrel Avenue, SE24 0EB London, Vereinigtes Königreich (hereinafter “GREM”).

(2) The Terms of Use for Owners and Prospects apply to owners, and the General Terms and Conditions for Makler apply exclusively to Makler and Makler firms.

(3) Buyers who opened their account before these Terms took effect and accepted the Terms of Use for Owners and Prospects continue to use the Platform under those terms until they confirm the present Terms.

§ 2 Services for buyers

(1) GREM provides buyers, free of charge, with: the marketplace with properties in Germany, market analyses and AI estimates, requests concerning individual properties, the search request, the choice of a Makler and the confirmation of financing.

(2) A request concerning a property goes to the Makler who offers the property. If the owner offers the property without a Makler, the owner receives the request if they have booked a GREM package for the property; otherwise the owner is notified, and the request waits until the owner chooses a Makler or activates a package.

(3) Makler in the selected region see a search request without the buyer’s contact details. Only a Makler who accepts the search request receives the contact details, and only after confirmation by the buyer.

(4) If the buyer uploads evidence of financing or equity, Makler see only the result of the review (“Financing verified” or “Capital verified”) and an amount range, never the document itself.

§ 3 Role of GREM

(1) GREM is not a Makler. GREM is not a party to any Makler contract, purchase agreement or lease agreement, does not conduct negotiations and does not participate in the conclusion of such contracts.

(2) Whether the buyer concludes a Makler contract and pays a commission is agreed by the buyer directly with the Makler. GREM receives neither a commission nor any other remuneration from the buyer.

(3) GREM reviews neither the legal circumstances of a property nor the information provided by the parties offering properties. The review of ownership and encumbrances is a matter for the notary and the contracting parties.

§ 4 Costs

Registration and use of the Platform are free of charge for buyers. Should GREM offer buyers paid services in the future, the price will be displayed before the order is placed; a contract for such services is concluded only by means of a separate order.

§ 5 Registration, account

(1) Use requires an account. The buyer must be of legal age and provide true information. Login credentials must be kept secret.

(2) The buyer may delete their account at any time in the GREM account. GREM may terminate a free account with two weeks’ notice and may block it immediately in the event of misuse.

§ 6 Transmission of contact details

(1) A buyer’s contact details are transmitted only to the party offering the requested property (Makler or owner) or to the Makler whom the buyer chooses or whose acceptance of their search request the buyer confirms.

(2) In each case, transmission takes place only with consent, which the buyer may withdraw at any time with effect for the future. The buyer can find the consents given and the option to withdraw them in the GREM account under “My consents”.

§ 7 Obligations of the buyer

(1) The buyer uses the Platform only for their own purchase or rental intentions. Collecting data of other users and advertising via the messaging function are not permitted.

(2) The buyer uploads only content to which they hold the rights, and no unlawful content.

§ 8 AI, information on properties

(1) AI valuations, market labels such as “in line with market”, “below market” or “above market” and market analyses are non-binding, automatically generated initial estimates and not an expert opinion on market value.

(2) Information on properties originates from the parties offering them. GREM gives no warranty as to its accuracy and completeness.

(3) How GREM processes personal data is explained in the Privacy Policy.

§ 9 Liability

(1) GREM is liable without limitation in cases of intent and gross negligence, for injury to life, body or health, and under the Product Liability Act.

(2) In cases of slight negligence, GREM is liable only for breach of material contractual obligations and limited to the foreseeable damage typical for the contract.

(3) GREM is not liable for the information and services of Makler, owners and other users.

§ 10 Amendments

Amendments to these Terms will be communicated by e-mail at least four weeks before they take effect. The buyer may delete their account until then.

§ 11 Final provisions

(1) The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected.

(2) The language of the contract is German. Translations are for information only.

(3) If any provision is invalid, the remainder of the contract remains valid.
